Terms of Use

Please carefully read the following website terms and conditions of use, before using or obtaining any information, products or services through our website including making any bookings. Access to any information on our website and use of our website is conditional on your acceptance of these Terms of Use (“Terms”), without qualification. By using our website (including by making a booking), you agree to be bound unconditionally by these Terms. If you do not accept all of these Terms, then you are required to immediately exit our website. We are a proud member of First Travel Group and have linked you to this page to reference our Terms of Use and Privacy Policy. For the avoidance of doubt, references in these Terms to “First Travel Group Member”, “First Travel Group” “we”, “our” and “us” shall be a reference to us as a member of First Travel Group.

1 - Use of Site
1.1 We are a New Zealand registered company and the information on this website is directed solely at those who access the website and travel from New Zealand.
1.2 We reserve the right to amend or suspend these Terms without prior notice to website visitors. We may also change any aspect of the website or its content without prior notice.
1.3 Neither our website nor the content, data, information or materials on it may be copied, reproduced, modified, transmitted, distributed, republished, uploaded, sold, or transferred, except that one copy of materials presented on this website may be copied and transmitted on a single computer strictly for personal, non-commercial use.
1.4 These Terms are governed by the laws in force in New Zealand and you hereby submit to the exclusive jurisdiction of the courts of New Zealand and/or any relevant tribunals for determining any dispute concerning these Terms.
1.5 You must use our website in a responsible and co-operative manner and, without limitation, you must not:
a) make any fraudulent, speculative or false enquires, bookings or reservations or requests using our website;
b) knowingly transmit any virus or other disabling feature to our website;
c) transmit to our website any threatening, defamatory, pornographic, political, or racist material or any material that is otherwise unlawful is expressly prohibited;
d) tamper with, hinder the operation of or make unauthorised modifications to our website;
e) use our website while impersonating another person;
f) delete data from our website without our permission;
g) frame our website as part of another site or cache this website for commercial benefit; or
h) breach any third party’s rights (including intellectual property rights and obligations of confidentiality owed to third parties) or infringe any laws using our website.
1.6 We do not warrant that our website is free from computer viruses or other properties that may cause loss or damage.
1.7 We reserve the copyright and all proprietary rights in our website and all content. The material contained within our website is the property of First Travel Group or its affiliates unless identified as belonging to third parties. 1.8 Our website may contain links to other websites. We are not responsible for the content of other websites; we are not recommending these websites or their products or services to you. If you suffer any loss or damage from visiting another website or using a third parties product or service, we are not liable. Any person who wishes to establish a link with our website must obtain prior written permission from us.
1.9 To the extent permitted by law, neither First Travel Group nor any of its related bodies corporate, directors, employees or agents shall be liable for any loss or damage in contract, tort or otherwise (including direct, indirect, consequential or other) which may arise as a result, directly or indirectly, from the use of our website and/or any of the information or material contained in this website and/or use of or access to any other information or material via web links from our website or any inability to access or use our website. First Travel Group’s liability will also be limited to the extent that any relevant international conventions (for example the Montreal Convention in respect of travel by air) limit the amount of compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage. Under circumstances where First Travel Group’s liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required under applicable law (including the Consumer Guarantees Act 1993). This liability clause is subject to your rights under the Consumer Guarantees Act and nothing in these terms and conditions is intended to limit any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

2 – Pricing & Booking information
2.1 Unless otherwise stated, all prices stated are in New Zealand dollars and are inclusive of all taxes including goods & services tax (GST), airport taxes, fuel surcharges and insurance levies. Certain taxes are mandatory in various countries. There may also be an additional local tax charged at some airports. All taxes are subject to change without notice. Airline taxes will be confirmed at the time your airline ticket is issued.
2.2 All prices featured on this website are subject to availability and conditions are subject to change without notice. We are reliant on information supplied to us by providers and other third parties. Therefore, prices and availability may change after prices are published on this website and before you book your holiday or travel arrangements. Whilst all endeavours are made to ensure all information on this website is accurate and up to date, by using this website you acknowledge that we have no responsibility for the accuracy, completeness, currency or availability of this information.
2.3 Your agreement for any travel booked featured on our website is with the relevant provider, and we act as an agent only. Our obligation to you is to (and you expressly authorise us to) make travel bookings on your behalf and to arrange relevant contracts between you and travel providers including bookings made via our website. All bookings are made subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by these providers. We can provide you with copies of the relevant provider’s terms and conditions on request. Your legal rights in connection with the provision of travel services are against the specific provider and, except to the extent a problem is caused solely by fault on our part, are not against the First Travel Group member (and, to that extent, are subject to clause 1.10).
2.4 We shall not be responsible for the content of any material or promotion supplied by or derived from providers and shall not be liable for any direct or indirect loss or damage suffered by you (or any other party) from accessing, using, relying on or trading with such providers.
2.5 Whilst every effort is made to ensure that all information and prices displayed on this website are complete and accurate, errors may occur from time to time. We reserve the right to correct any errors or omissions, and any booking made based on an incorrect price will not be valid. You will be advised of any such error at the earliest opportunity whereupon you will then have the option to pay the correct price or to cancel and receive a full refund of any monies already paid by you.
2.6 Prices do not include any items of a personal nature such as telephone calls, alcoholic beverages, gratuities, meals, transport within your home port and return etc, unless otherwise indicated.
2.7 “Specials” are available for a limited time. You must check with us whether a “special” displayed on our website is still available. There may be particular terms and conditions that apply to “specials”. You must contact us as a First Travel Group member or the third party provider to determine whether any particular terms and conditions apply.

3 – General Booking Conditions
3.1 You are responsible for obtaining all passport, visa and health information required. We will assist you to obtain such information on request, however, the final responsibility for obtaining the necessary information and complying with any passport, visa and health requirements remains with you. When assisting with an international travel booking, we will assume that all travellers on the booking have a valid New Zealand passport.
3.2 Special requests will be passed on to the travel providers but can never be guaranteed. We should be advised of any special request no later than 7 days prior to departure.
3.3 All airlines have their own rules and regulations with regard to ticketing. We will not accept responsibility for non-compliance with such regulations and strongly recommend that you check these details with the airline prior to travel.
3.4 We do not take responsibility for any flight time or number alteration made by airlines.
3.5 Your ability to amend and cancel bookings is dependent upon the terms and conditions applied by each travel provider. Cancelled bookings may incur providers fees, which can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Provider fees may also apply where a booking is changed and when tickets or documents are re-issued. Where a First Travel Group member incurs any liability for a provider cancellation fee for any booking which you change or cancel, you agree to indemnify the First Travel Group member for the amount of that fee. Where you seek a refund for a cancelled booking for which payment has been made to the provider, the First Travel Group member will not provide a refund to you until we receives the funds from that provider. In additional, the First Travel Group member reserves the right to charge its own fees for any requested amendments or cancellations.
3.6 We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. We will not take responsibility for, and have no liability to, any clients who choose not to take out a comprehensive travel insurance cover for travel arrangements made.

4 - Privacy Policy
4.1 We understand and respect the importance of your privacy and is committed to protecting your privacy in accordance with the Privacy Act 1993. In accordance with this, you may at any time access and change your personal information or subscribed services.

We will take all reasonable steps to keep your information secure and will not disclose it except for the notification to you of our or travel providers offers and information or when required to do so by law. No personal information is collected from you when you browse the website. This can only be obtained when:
a) you make an enquiry online, by email, letter, fax or on the phone;
b) you purchase travel products from us, and necessary personal information must be provided;

c) when you subscribe to our newsletter, enter competitions, complete surveys, provide feedback or register with us.

5 - Cookies
5.1 In order to help us maintain and improve our services to you, we may on some occasions store a “cookie” on your computer to collect information about your use of the website. This information may include the pages you browse, including the products and services viewed. In doing this, we can manage and develop offers tailored to your individual interests and needs. Cookies are a feature of web browser software that allows web servers to temporarily transfer information within your web browser and enables the sites or service providers systems to recognize your browser and capture and remember certain information. Most computers automatically accept cookies, but you can choose to disable cookies from being stored on your computer by changing your browser settings, however this may result in a limited experience of our functionality and services.

5.2 Third party vendors, including Google, show our ads on sites on the intranet and use cookies to serve ads based on your prior visits to this website. 5.3 We may also collect information regarding what you browse, including products and services viewed. By doing this, it best helps us measure respective numbers to various pages and sections including details of searches made. Collecting this information also best helps us measure the usage of advertising banners and other click through options from the website. This information may be disclosed to third parties, excluding any personal information on visitors.
